§ 1 Content
(1) These general terms and conditions are content of the proportion of use between the Nasenprinz Funworx (operator) and the users of services of the operator (occupant). With the use of this services the user accepts these general terms and conditions. The comprehension of the general terms and conditions is contradicted assertively.
(2) The proportion of use starts with the registration of the user at the particular service of the operator and the acceptance of the registration of the operator through the creation of an accesa authorisation (account). It is terminated with the cancellation of the user, eg. the delation of his account or the suspensio on delation through the operator as well as through the dismissal of the operator.
§ 2 Scope of supply and services
(1) The operator gives way to the user to use his services in their particular composure in through the provision in the internet. The user has to assure the technical condition hisself. (2) The user has no claim for using the services of the operator. Particulary the operator reserves to himself to decline or circumscribe a registration to one or more services. (3) The operator does not assure, that the services satisfy the needs of the user. Particulary the operator does not give warranty for the completeness and correctness of the given information; the functionaly and textual error-free progress of the services and the acceptability of the services for the users aim. The user has no claim for adjustment of disadvantages that are caused by a deficient or not functionaly correct working service. (4) Furthermore the user does not give warranty for the full or fractional accessibility of the service. This particulary, but not exclusively, obtains in the malfunction of the server or programming errors (bugs). The operator is also authorised to stop or confine the services everytime and without announcement for reparation, maintainance or extension of plant or other, assimilable Reasons. (5) The services are developed consistently, are adapted and changed. Because of that the operator can change the textual, optical, technichal and other appearence of his services anytime. A claim for the user to keep certain technical basic conditions or circumstances ist not given. (6) Advices, tips or suggestions to the devolution of the services which the operator and its assitants, as well as his subsidiaries, accord are always non-binding. The user has no claim for adjustment of disadvantages caused by that.
§ 3 Coins
(1) The operator makes it possible for the user to buy so called coins. The costs of one coin are shown on the particular web site of the service. (2) With these coins the user has the possibility to buy certain amenities compared to a normal account. The correct description of the bought amenity and the amount of needed coins is shown on the web site of the particular service and varies. The coins only count for the service for which they were acquired and are not assignable. For the amenity additional utilisation conditions count: the service description. The operator reserves to himself to change these in character, amount and content. (3) There is no duty to buy coins. The amenities can be unique or limited in time. The ones that are limited in time are expired after the time is exhausted. They can be accounting again if they are still offered. (4) A refund for acquired coins is not possible.
§ 4 Liablitiy
(1) The operator is liable for attributable through the operator or its assistants caused (in line with the utilisation of the service) damage to persons (only for intent and gross fault) and for damage to property (only for intent). (2) The user is liable for all damages he has to act for.
§ 5 Responsibilities of the user
(1) The user commits to keep his access data of each server secret. Passing them on to other people is forbidden. (2) The user commits to use only one account for each server at the same time. The use of more than one account on one server at the same time (so called multi-using) is forbidden. (3) The use of extern scripts or programs to simplify or automate the services (so called bots) is forbidden. (4) The user commits not to use program-errors (so called bugs) for his advantage. Owned advantages have to be given back and can be canceled by the operator. The user has to keep bugs secret and tell the operator immediately. (5) The user commits not to dispread any fotos, links, names, words or other comments with promoting, politically, offending, sexistic, pornographic or other ethically reprehensible, particularly racist as well as rightist or left extreme content in line with the service. Furthermore he commits not to use any copyright names, pictures or terms. In case of doubt the user has to remove the blamed contents of the operator or, depending on the case, the operator has the right to remove them hisself. (6) The user has to obey the dispositions of the operator and his assistants. Particularly this also counts for the dispositions of the administrator or the moderator of the appendant panel. (7)An offence against the responsibilities gives right to the operator to suspend the user from one or all services and to delete/lock the account or all accounts of the user. A refund for creditet coins or amenities of one or alle accounts will not be given.
§ 6 Cancellation
(1) The user has the right to terminate his attendance to one, divers or all services directly without giving any reason or to keep a term. (2) The opertor has the right to cancel one, Users or all services anytime and without keeping a term, if the services are dropped. (3) In case of a cancellation, from what side ever, the user does not get a refund if he still had coins or other creditet valid amenities.
§ 7 Written form
Side letters for these general terms and conditions need to have this written form to be valid. This also counts for the changing of the writing form demand.
§ 8 Severability clause
If there are any rules in these general terms and conditions that are not acceptable or futile the other rules are still intact. The parties commit to substitute the futile rule for a rule which is next to a permitted rule.
